Notice to 1st respondent is already dispensed with by order dated 19.03.2025.

2. Mr.D.Nitin, learned counsel takes notice for the 2nd respondent.

3. The 3rd respondent remained exparte before the Tribunal. Hence, notice to him is dispensed with.

4. It is seen from the records that the original petition already dismissed against the 4th respondent/insurance company. Therefore, it is not a necessary party. Hence, notice to 4th respondent is dispensed with.

5. Heard the learned counsel for the petitioner and learned counsel for the contesting 2nd respondent.

6. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay of 973 days in filing the above CMA is condoned.

7. It is made clear that petitioner/claimant is not entitled to claim interest for the delay period of 973 days on the enhanced award amount in the event of his success in the appeal.

8 Registry is directed to print the name of Mr.D.Nitin, learned counsel for the 2nd respondent at the time of admission. nr 03.04.2025 Note:Registry is directed to number the CMA and list it for admission, if it is otherwise in order.
