IN THE HIGH COURT OF JUDICATURE AT MADRAS

( Criminal Jurisdiction ) Monday, the Twenty Third day of October Two Thousand Seventeen PRESENT The Hon`ble Mr Justice P. N. PRAKASH CRIMINAL ORIGINAL PETITION No.21798 of 2017 V.VIGNESH@VIKKI [ PETITIONER / ACCUSED ] Vs THE STATE OF TAMILNADU REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, VELAMPALAYAM POLICE STATION, TIRUPPUR CITY. CRIME NO.572 OF 2017.

For Petitioner : M/S.A.SARAVANAN Advocate For Respondent : MR.K. MADHAN, Government Advocate (Crl.Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- This is the third anticipatory bail petition and the earlier petitions have been dismissed by this Court in Crl. O.P. Nos. 17452/17 and 19080/17.

2. It is the case of the prosecution that on 15.8.2017, the accused, who were members of Subash Chandra Bose Welfare Society, held Independence Day celebrations and when the cultural programmes were going on, the victim had come there to watch the program. It appears that the accused had picked up a quarrel with the victim pursuant to which on 17.8.17, the accused, along with others, had stabbed the victim resulting in serious injuries to him. Though this Court had granted anticipatory bail to Suryaprakash @ Jothi and Kathiravan @ Kathir in Crl. O.P. No.19080/2017 on 18.9.17, this Court had dismissed the anticipatory bail insofar as this petitioner is concerned in view of the serious nature of allegations against him.

3. Learned counsel appearing for the petitioner submitted that there is no previous case as against the petitioner and also submitted that the injured has been discharged. However, that cannot be a reason or ground for grant of anticipatory bail to the petitioner in a case of this nature.

4. There being no change in the fact situation for granting anticipatory bail, this petition is accordingly dismissed. -sd/- 23/10/2017 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
