Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition that the petitioner is directed to deposit a sum of Rs.50,000/- (Rupees Fifty thousand only) before the Registered Advocate Clerks Association, Thiruvallur and pass further or other order or orders as this Hon'ble court.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.J.B.SOLOMON PETER KAMAL DOSS, Advocate for the petitioner and of MR.L.BASKARAN, Govt. Advocate (Crl. Side) [IN Crl.M.P.No.4651/2022] and MR.R.KISHORE KUMAR, Govt. Advocate (Crl. Side) on behalf of the Respondent [ IN Crl.M.P.No.6217/2022] the court made the following order:- The Petitioner has filed this petition seeking to modify the condition that the petitioner was directed to deposit a sum of Rs.50,000/- (Rupees Fifty Thousand only) before the Registered Advocate Clerks Association, Thiruvallur, imposed by this Court in Crl.O.P.No.1074 of 2022 dated 20.01.2022.
2. The learned Counsel appearing for the petitioner submitted that the petitioner is suffering from Tuberculosis disease and underwent treatment. She also further submitted that the petitioner is ready to produce the document sureties worth of Rs.50,000/- (Rupees Fifty Thousand only) or two Government sureties to the satisfaction of the court and will not abscond and further undertake to co-operate with the trial. She further submitted that the petitioner is the only bread winner of the family and he is not able to mobilize the funds. Hence, the present modification petition has been filed.
3. Heard the learned Government Advocate (Crl.Side) appearing for the respondent police.
4. Considering the facts and circumstances of the case, reason is justifiable, the condition already imposed by this Court is modified and the petitioner is directed to deposit a sum of Rs.20,000/- (Rupees Twenty Thousand only) to the Registered Advocate Clerks Association, Thiruvallur, within a period of two weeks from the date of receipt of a copy of this order.
