.....Respondents Prayer:
Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus directing the 1st respondent to pass orders on the petitioner's representation dated 03.01.2020 within the stipulated period. For Petitioner : Mr.S.Parthasarathy For Respondents : Mr.A.Selvendran Government Advocate for R1
O R D E R
This writ petition has been filed for the issue of writ of Mandamus directing the 1st respondent to consider the representation made by the petitioner on 03.01.2020, wherein the petitioner has sought for the refund of the fees from the 2nd respondent college.
2. When the matter was taken up for admission, the learned Government Counsel appearing on behalf of the respondents submitted that the representation made by the petitioner was considered and since the petitioner had joined the college on 05.07.2018 and left the college on 06.08.2018, there is no scope for refunding the fees, more particularly since the petitioner had undergone the course for nearly a month. The learned Government Counsel further submitted that the decision taken by the petitioner to leave the college is an independent decision of the petitioner and that will not give a right to the petitioner to seek for the refund of the fees.
3. In view of the specific stand taken by the respondents, no further orders can be passed in this writ petition. If the petitioner is aggrieved by the decision taken by the respondents, it is left open to the petitioner to work out her remedy in the manner known to law, since the grievance is more in the nature of recovery of money.
4. This writ petition is disposed of accordingly. No costs.
