ORDER

This Writ Petition has been filed challenging the impugned enquiry call letter, dated 09.02.2026 issued by the 2nd respondent, calling the petitioner's husband for enquiry.

2. Mr.K.Surendran, learned Additional Government Pleader, accepts notice on behalf of the respondents 1 to 4. Since no adverse order is passed against the 5th respondent in this writ petition, notice to the 5th respondent is dispensed with by this Court.

3. According to the petitioner, a valid sale deed was executed in her favour by the 5th respondent, who is her father-in-law for valuable consideration. According to her, the 5th respondent has now filed an application under the Maintenance and Welfare of Parents and Senior Citizens Act (in short 'the Senior Citizens Act') seeking to cancel the said sale deed executed in favour of the petitioner, which is arbitrary and illegal. She also contends that without issuing any notice to the petitioner, Page No.2 of 6

the 2nd respondent is considering the application submitted by the 5th respondent under the Senior Citizens Act, for cancellation of the sale deed standing in the name of the petitioner. The apprehension of the petitioner in this writ petition is that final orders will be passed by the 2nd respondent without hearing the objections of the petitioner. Since the sale deed stands in the name of the petitioner, necessarily, the 2nd respondent will have to hear the petitioner and only thereafter pass final orders on the 5th respondent's application seeking for cancellation of sale deed standing in the name of the petitioner.

4. The petitioner cannot stall the impugned proceedings by filing this writ petition challenging the impugned enquiry call letter, dated 09.02.2026 issued by the 2nd respondent. The only limited relief that the petitioner can seek from this Court is for a direction from this Court to the 2nd respondent to consider the petitioner's objections as raised in this writ petition and only thereafter pass final orders on the 5th respondent's application seeking for cancellation of the sale deed standing in the name of the petitioner.

For the foregoing reasons, this Writ Petition is disposed of by directing the 2nd respondent to give an opportunity of hearing to the petitioner and only after hearing the objections of the petitioner in the impugned proceedings, the 2nd respondent is directed to pass final orders on the 5th respondent's application filed under the provisions of the Senior Citizens Act seeking for cancellation of the sale deed standing in the name of the petitioner, by adhering to the principles of natural justice.
