ORDER

The writ petition has been filed challenging the order dated 17.08.2017 passed the third respondent and further direct the third respondent to remove the entries in the Encumbrance Certificate with respect to Document No.1650/2009 and Document No.1728/2009 on the file of the third respondent.

It is seen that the sole petitioner died on 01.09.2022 itself. Even till today the legal heirs did not take any steps to implead themselves as party to this writ petition. It shows that they have no interest to pursue the present writ petition. 3.

In view of the above facts and circumstances, the Writ Petition stands dismissed as abated. However, the legal heirs of the deceased petitioner are at liberty to file petition to set aside the order of abatement in accordance with law. Consequently, connected miscellaneous petition is also closed. There shall be no order as to cost.
