This Criminal Original Petition is filed seeking direction not to harass the petitioner under the guise of enquirying the complaint given by one Nandakumar.

According to the learned counsel appearing for the 1/4

petitioner, it is purely a civil dispute regarding the sale of immovable property. Under the guise of enquiry, the police is harassing the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent police states that claiming property who have purchased the property of the complainant through power of attorney, the petitioner has not paid sale consideration to the land owner and trying to grab the money. Hence the allegations of the complainant Nandakumar is under investigation. The petitioner has appeared before the Investigating Officer and has placed the documents to show that the dispute is civil in nature. The defacto complainant has been summoned to appear today and after enquiry appropriate action will be taken on the complaint. 4.

In view of the above submission, this Court finds that the police has received the complaint of one Nandakumar and investigating the matter. If there is no element of criminality in the transaction, they will pass appropriate orders on the complaint based on the materials produced by the parties. From the submissions, this Court finds that there is no harassment made to the petitioner by the police. Hence this 2/4

Criminal Original Petition is disposed of with direction to the respondent police to conduct the investigation in accordance with law and proceed as per the procedure established.
