Order The petitioner, who apprehends arrest for the alleged offence under Sections 363 of IPC and section 5(l), 6 of POCSO Act and Section 9 of Prohibition of Child Marriage Act, 2006 in Spl.S.C.No.49 of 2018 on the file of the learned Sessions Judge, Fast Track Mahila Court, Tiruppur seek anticipatory bail.

2. Learned counsel for the petitioner submitted that due to his absence before the trial Court on 15.11.2023, the trial Court issued a non-bailable warrant against him. He further submitted that the petitioner is now ready to appear before the Court concerned and hence prayed for the grant of anticipatory bail.

3. At this juncture, the learned Government Advocate (Crl.Side) drew the attention of this Court to the fact that only after knowing that he has been declared as a proclaimed offender, he has come up with the present petition. If the petitioner is enlarged on bail, there is every possibility that he would abscond again.

4. I have given my anxious consideration to either side submissions. The case is of the year 2018 and that the petitioner is absconding since 2023 and even now the petitioner has not surrendered and apart from that the Court has already declared him as proclaimed offender on 18.02.2026. In such a view, this Court finds no merits in the present petition.

5. In the result, this Criminal Original Petition is dismissed. 02-03-2026 SHL To
