Prayer: Writ petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus to direct the respondent to hear and dispose the petitioner's written Form A submitted under Section 16 of the National Trust for welfare of Persons with Austism, Cerebral Palsy, Mental Retardation and Multiple Disabilities act, 1999 on 11.04.2017 in accordance with law within the time stipulated by this Court. The petitioner seeks for a Mandamus directing the respondent to hear and dispose of the petitioner's written Form-A submitted under Section 16 of the National Trust for welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999 on 11.04.2017 in accordance with law.
2. It is stated by the petitioner that his father died on 06.02.2004 leaving behind his legal heirs. It is further stated that his mother also died on 17.06.2016 and the petitioner, his sister Chandrakala and Jayanthi and another brother namely, Dinesh Kumar who is a mentally retarded person as legal heirs. Based on the doctor's advise, he has to take care of the said brother by safeguarding his interest as a care taker of the family. Therefore, he filed the above application on 11.04.2017 https://hcservices.ecourts.gov.in/hcservices/
for passing appropriate orders. The grievance of the petitioner is that the said application has not been considered by the respondent so far.
3. Considering the above stated facts and circumstances and considering the urgency involved in this matter, this Court is of the view that the respondent cannot delay the matter any further. Accordingly, this Writ Petition is disposed of by directing the respondent to consider the Form-A submitted by the petitioner dated 11.02.2017 and pass orders on the same on merits and in accordance with law after giving due opportunity of hearing to the petitioner within a period of four weeks from the date of receipt of a copy of this order. No costs.
