Heard Mr. B.Jawahar, Learned Counsel for the Petitioner, Mr. K.Karthick Jeganath, Learned Government Advocate appearing for the First Respondent and Mr. C.Jayaprakash, Learned Counsel for the Second Respondent and perused the materials placed on record, apart from the pleadings of the parties.

The Petitioner, while working as Clerk cum Supervisor in the co-operative society of the Second Respondent, was dismissed from service, but such action taken was set aside by the Labour Court in an industrial dispute bearing I.D.No.577 of 1993 raised by him before the Labour Court, Vellore. However, the Second Respondent did not reinstatement him in service stating that there was no vacancy to accommodate him and the same would be considered in future, if any vacancy arises. The Petitioner claims to have filed a Revision Petition under Section 153 of the Tamil Nadu Co-operative Societies Act, 1953 before the First Respondent and has sought for a direction for disposing the same within a specified time limit. 2/4

In response, Learned Government Advocate appearing for the First Respondent, on instructions, states that the said Revision Petition would be disposed following the prescribed procedure, after hearing all parties concerned within a period of two months from today. It shall be incumbent upon the First Respondent to carry out the said undertaking and file a report of compliance before the Registrar Judicial of this Court.

In fine, the Writ Petition is disposed on the aforesaid terms. No costs. 21.04.2023 kv Index: Yes/No NCS: Yes/No Note: Issue order copy by 18.08.2023.
