ORDER
This writ petition has been filed to direct the third respondent to cancel the patta issued in favour of the sixth respondent insofar as it relates to the common pathway (for 60 flat owners) situated at Mambalam Taluk, Virugambakkam Village in S.No.189/2, 2A and 2B and 183/3 Door No.44/331, Arcot Road, Virugambakkam Village, Chennai 600092 to the extent of 5844 Sq.Ft., based on the petitioner's representation dated 22.12.2025, within a time frame to be fixed by this Court.
2.The petitioner claims that in view of the issuance of patta in favour of the sixth respondent, the common pathway of the 60 flat owners in the property, situated at the address, morefully disclosed in the prayer to this writ petition has been greatly affected. The petitioner is one of the flat owners. Under those circumstances, the petitioner had given a representation on 22.12.2025 to the
third respondent seeking for cancellation of patta, standing in the name of the sixth respondent insofar as it relates to the common pathway. Since the said representation was not considered, the petitioner has filed this writ petition. 3.Mr.D.Ravichander, learned Special Government Pleader accepts notice on behalf of respondents 1 to 5. Since no adverse order is being passed against the sixth respondent, notice to the sixth respondent is dispensed with by this Court.
4.No prejudice would be caused to the official respondents if the petitioner's representation, as stated supra, is considered, on merits and in accordance with law, after hearing the objections of the sixth respondent and any other third party whom the third respondent deems it fit to enquire, within a time frame to be fixed by this Court.
5.This Court is not expressing any opinion on the merits of the petitioner's representation.
6.For the foregoing reasons, this writ petition is disposed of by directing the third respondent to pass final orders, on merits and in accordance with law on the petitioner's representation dated 22.12.2025 seeking for cancellation of the sixth respondent's patta insofar as it relates to the common pathway for the
60 flat owners in the property, morefully disclosed in the prayer to this writ petition, after hearing the objections of the sixth respondent and also any other third party whom the third respondent deems it fit to enquire within a period of 12 weeks from the date of receipt of a copy of this order.
