Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of 1/4

India praying for a Writ of Mandamus, directing the respondents to reconduct the counseling in pursuant to the Circular issued by the 2nd respondent in Reg.No.000033/E3/1/2024 dated 05.03.2024 by reckoning the station seniority of the petitioners for transfer within the Directorate from the date of posting order instead of date of joining the previous station for arriving priority in the transfer counseling as per G.O.(2D) No.131, Health and Family Welfare Department, dated 21.11.2007 and to pass orders granting permanent solution to count the station seniority only from the date of posting order / the date of counseling, instead of joining date, in consideration of representation submitted by the petitioners dated 06.03.2024.

The issue raised in the Writ Petition has been addressed by the respondents through the issuance of G.O.(D)No.1355, Health and Family Welfare (A1) Department, dated 30.12.2024. In the said Government Order, it was stated that for transfer counseling, station seniority shall be calculated from the date of the transfer/promotion orders issued by the Government. However, this method of calculating station seniority will not apply if there is any willful delay on the part of the Medical Officer in relieving from the old station or joining the new 2/4

station upon transfer/promotion.

Recording the aforementioned Government Order, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
