Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the respondent to survey and fix the boundaries for the land of the petitioner in survey No.716/10 A2 an extent of 0.07 Acre (1523 Sq.ft) purchased by him vide registered sale Deed Document No.5432/2004 situate at Paruthipatti Village, within the Avadi Sub-Registrar Jurisdiction, Thiruvallur District, based on his application dated 29.08.2016 along with requisite payment challan submitted to the respondent, within a time frame to be fixed by this Court.

O R D E R

Mr.P.V.Selvakumar, learned Additional Government Pleader takes notice for the respondent. By consent of the parties, the main writ petition itself is taken up for final disposal at the admission stage itself.

The petitioner seeks for a Mandamus to direct the respondent to survey and fix the boundaries for the land of the petitioner in survey No.716/10 A2 an extent of 0.07 Acre (1523 Sq.ft) purchased by him vide registered sale Deed Document No.5432/2004 situate at Paruthipatti Village, within the Avadi https://hcservices.ecourts.gov.in/hcservices/

Sub-Registrar Jurisdiction, Thiruvallur District, based on his application dated 29.08.2016 along with requisite payment challan submitted to the respondent, within a time frame to be fixed by this Court.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the respondent.

4. The grievance of the petitioner before this Court, is that the said representation has not been considered so far. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the respondent to consider the representation of the petitioner dated 29.08.2016 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
