O R D E R
(Order of the Court was made by The Hon'ble Chief Justice) On hearing the learned counsel for parties, it transpires that the dispute is really whether the petitioner, apart from the patta land, has encroached upon some Government land for which apparently no demarcation has been carried out, though an order was passed under Section 6 of the Tamil Nadu Land Encroachment Act, 1905.
2.It is, thus, agreed that the respondent will carry out demarcation at site on 31.01.2017 at 11.00 a.m. onwards with the help of a surveyor and the representatives of the petitioner may also be present there. It would be the responsibility of the petitioner to inform to the current tenants if they want to be at site. On such demarcation carried out, if it is found that there is any encroachment, then the petitioner and her current tenants will remove the encroachment within fifteen (15) days thereafter.
