The Criminal Appeal has been filed against the judgement in C.A.No.186 of 2005 on the file of the Additional District Judge, Salem, ( Fast Track Court No - I, Salem) dated 13th day of August 2007 reversing the judgment dated 20.09.2005 in C.C.No.288 of 2000 on the file of the Judicial Magistrate No - III, salem.

2. Today, when the matter was taken-up, the learned counsel appearing for the appellant submits that pending appeal, the sole appellant in this case died in the year 2010 and he also filed a memo to that effect.

3.In view of the submission and based on the memo filed by the learned counsel for the appellant, this Criminal Appeal is dismissed as abated.
