Civil Revision petition is filed under Article 227 of the Constitution of India to direct the Special Court for trial of Domestic Violence Cases, Coimbatore to dispose of the DVA.No.380 of 2019 at an early date. ORDER

The revision petitioners herein filed this revision seeking for speedy disposal of DVA.No.380 of 2019 on the file of the Special Court for trial of Domestic Violence Cases, Coimbatore.

Notice sent to the other side and caveator appeared. 3.

The learned counsel for the petitioners submits that the respondent / wife of the first petitioner herein is drag on the proceedings near about more than one year, without any progress after cross examination of RW1. The first revision petitioner, who is the husband always inclined to cooperate for the proceedings, but the same was dragged on by the wife by filing multiplicity of applications. Hence, he prayed to dispose of the case as early as possible. 4.

The learned counsel for the respondent submits that the first petitioner herein not complied with the order passed in MC proceedings and near about more than Rs.11 lakhs is arrear as interim maintenance, but one way or other evaded to pay interim maintenance. The wife is living with child and he only dragged the proceedings. The learned counsel for the petitioners submits that he is taking steps to challenge the order. 5.

But on seeing the fact that MC was filed in the year 2012 and so far, proceedings not came to end. But between parties, MC proceedings and DVC proceedings filed long back and she is living with the child and so far entire proceedings not came to end. However, trial has begun and now case is

at the stage of RW1. As such, the trial court is directed to dispose of the above case within a period of three months from the date of receipt of this order without giving unnecessary adjournments since because it is the Special Court to deal with the case.

With the above direction, this civil revision petition is disposed of. There shall be no order as to costs.
