ORDER
This writ petition has been filed for issue of writ of mandamus directing the 3 rd respondent to act upon the appeal submitted by the petitioner on 05.09.2024, wherein, the petitioner has sought for the cancellation of the patta that stands in the name of the 6 th respondent with respect to the subject property.
3/6 2.Heard Mr.D.Gopinathan, learned counsel appearing on behalf of the petitioner and Mr.A.Selvendran, learned Special Government Pleader appearing on behalf of respondents 1 to 5.
3.It is seen from records that the 6 th respondent had already approached this Court and filed W.P.No.33495 of 2024 seeking for the cancellation of patta issued in the name of one Kulasekaran and to issue the patta in her name. This writ petition was disposed of by an order dated 11.11.2024 by directing the Revenue Divisional Officer to pass orders on the appeal, within a period of twelve weeks.
4.After the above order was passed, notice was issued to the petitioner and others by the 3 rd respondent and thereafter, there was no progress. It is under these circumstances, the present writ petition has been filed before this Court. 5.Taking into consideration the facts and circumstances of the case and the materials placed before this Court and taking note of the earlier order passed
4/6 by this Court in W.P.No.33495 of 2024 dated 11.11.2024, there shall be a direction to the 3 rd respondent to dispose of the pending appeal after affording opportunity to the petitioner and respondents 6 and 7 on its own merits and in accordance with law, within a period of six weeks from the date of receipt of copy of this order.
