The applicants are the plaintiffs and they have filed this application seeking leave of the Court to receive the rejoinder to the plaint along with additional documents in T.O.S. No.29 of 2022.

2. The learned counsel for the respondent / defendant submitted that though there is no serious objection to receive the rejoinder, the applicants ought to have filed a separate petition to receive the additional documents and the said prayer cannot be clubbed along with the prayer seeking leave to file the rejoinder.

3. The objection of the respondent / defendant is only on technical grounds. Even if the additional documents are the same, it can only be subject to proof and relevancy.

4. In view of the above observations and also to save the further loss of time, this application is allowed. However it is made specific that additional documents which are sought to be filed by the applicants are only subject to proof and relevancy.
