ORDER
This writ petition has been filed to direct the 3rd, 4th and 5th Respondents to disburse the retirement benefits due and payable to the petitioner and consider the petitioner's representation dated 10.11.2025 sent to the respondents 3, 4 and 5 herein.
2.The case of the petitioner in brief is that the petitioner was working as a Pharmacist and during his service, false criminal case has been registered against him in C.C.No.86 of 2007 on the file of the Judicial Magistrate I, Perambalur and the petitioner was placed under suspension by order dated 30.01.2024 on the basis of the aforesaid criminal case and when the petitioner has attained the age of 2/6
superannuation on 31.01.2024, he was not permitted to retire from service pending conclusion of the criminal proceedings against him. Thereafter, the case was transferred to the Judicial Magistrate II, Perambalur and by Judgment dated 12.03.2025, the petitioner was acquitted. Thereafter, the petitioner sent a representation to the respondents seeking permission to retire from service and to settle his retirement benefits and the first respondent has permitted the petitioner to retire from service by proceedings dated 28.08.2025 and the same was forwarded to the fifth respondent for necessary action. Thereafter, the petitioner has submitted a detailed representation dated 10.11.2025 to the respondents 3, 4 and 5 seeking regularization of the period of suspension and retirement benefits. However, no order has been passed till date. Hence, the petitioner has filed the present writ petition.
3.Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondents and perused the materials available on record.
4.In view of the facts and circumstances of the case, the respondents 3, 4 and 5 are directed to pass orders considering the representation of the petitioner dated 3/6
10.11.2025 within a period of three weeks from the date of receipt of a copy of this order.
5.Accordingly, this writ petition is disposed of with the aforesaid direction. No costs. Consequently, the connected writ miscellaneous petition is closed. 10-03-2026 Index: Yes/No Speaking/Non-speaking order AY 4/6
