Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 120B of IPC, 1860 r/w Section 5 of the TNPID Act, 1997 as per charge sheet dated 28.05.2015 in CC No.08 of 2013 in Cr.No.03 of 2012, seeks anticipatory bail.

2. The learned Additional Public Prosecutor submits that on 10.07.2017, a Police Clearance was issued with Endorsement No.PCC/278/2017 on the passport of the petitioner, but even on the said date, a non bailable warrant was pending against the petitioner.

3. Considering the fact that NBW is pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. However, the petitioner is directed to appear before the learned Special Judge, Special Court under TNPID Act, https://hcservices.ecourts.gov.in/hcservices/

Coimbatore, within a period of two weeks from the date of receipt of the copy of this order and to file a petition under Section 70(ii) of Cr.P.C., to recall the NBW already issued against him. On filing of such petition, the concerned Magistrate is directed to consider the same on merits and pass orders on the same day.
