Mr.R.Anbalagan Order This civil revision petition has been filed, challenging the order dated 09.01.2026 passed by the Principal District Court, Kancheepuram in I.A. No.137 of 2017 in Ind.OP. No.31 of 2015.

2.By the aforesaid order, the Trial Court had restored Ind.OP. No.31 of 2015, which was earlier dismissed for default. The Trial Court had taken into consideration the reasons given by the respondents for allowing the application. The Trial Court found that sufficient cause was shown by the respondents for restoration of Ind.OP. No.31 of 2015. In paragraph No.5 of the impugned order, the reasons given by the Trial Court for allowing I.A. No.137 of 2017 in Ind.OP. No.31 of 2015 is re-produced hereunder: '5.Upon perusal of the materials on record, this court finds as follows. Upon perusal of the records, it is seen that the original restore petition filed by the petitioner/plaintiff was misplaced due to which necessary action was initiated for reconstruction of the lost papers.

Thereafter, upon obtaining the no objection from the respondents, the petition in I.A.No.137/2017 was reconstructed. Hence, there is no impediment to pass an order in the application. The present petition is filed to restore the Indigent OP which was dismissed for default.

on merits. It is also relevant to note that the petition was filed within a period of 30 days from the date of dismissal of the Indigent O.P. Hence, considering the reasons given, this court is inclined to allow this petition.'

3.Since sufficient cause has been shown by the respondents, the Trial Court had rightly allowed the application filed by the respondents to restore the Ind.OP. No.31 of 2015 to its file. This Court does not find any infirmity in the impugned order. The petitioners will have to necessarily contest the Ind.OP. No.31 of 2015, on merits before the Trial Court. 4.For the foregoing reasons, this Court does not find any merit in this petition. Accordingly, this Civil Revision Petition is dismissed. Consequently, connected CMP is closed. No costs.
