ORDER

This petition has been filed to direct the 2nd respondent police to register the petitioner complaint dated 09.04.2015 pending on the file of the Inspector of Police, Traffic investigation (South Zone), Parangimalai, Chennai - 16.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the respondents.

3. It is seen that the petitioner met with a road accident on 04.03.2015 and was admitted in the hospital. He gave a complaint, stating that, he does not know the number of the vehicle, which dashed him. Therefore, the petition enquiry in CSR No.418 of 2015 was closed on the ground that the petitioner himself did not want to pursue the matter any further. Thereafter, the petitioner gave a representation on 22.04.2015, in which, it is stated that the vehicle which hit against his vehicle was a two wheeler bearing registration No.TN 11 S 9727. present complaint dated 09.04.2015, in which, it is stated that the registration number of the vehicle which hit his vehicle was Karishma Brand vehicle registration No. TN 11 X 9727.

4. From the above, it is clear that the petitioner is giving conflicting stand every time. It is common knowledge that for making bogus claim of insurance, such complaints are given. Therefore, the respondent police is directed to conduct an enquiry on the complaint dated 09.04.2015 and if it is found that the petitioner has given false complaint, appropriate action should be taken against the petitioner. If it is found that the petitioner's case is correct, then, a regular FIR to be registered against the driver of the vehicle bearing registration No.TN 11 X 9727, if he had been at fault.

In view of the above, the criminal original petition is closed.
