..Respondent Prayer:- Contempt petition filed under Section 11 of the Contempt of Courts Act 1971 to punish the respondent for wilful disobedience of the order of this Court in W.P.No.34274 of 2004 dated 08.11.2013.

O R D E R

This contempt petition is filed complaining that the order passed by this Court in W.P.No.34274 of 2004 dated 8.11.2013 has been disobeyed.

2. This Court dismissed the said writ petition filed by the Transport Corporation challenging the award of the Labour Court wherein and whereby, the workman, who is the petitioner in this contempt petition was directed to be reinstated into service with 50% of backwages. The grievance of the contempt petitioner was that even after dismissal of the writ petition by this Court and even though he was reinstated into service, 50% of the backwages was not given to the contempt petitioner as awarded by the LabourCourt.

3. Today, the learned counsel appearing for the respondent Transport Corporation submitted that already a sum of Rs.8,72,800/- was paid to the contempt petitioner representing 50% of the backwages. However, the learned counsel appearing for the petitioner submits that there is some difference in calculating 50% backwages and therefore he has made a representation to the Transport Corporation for paying the differential amount.

4. Considering the above stated facts and circumstances, I am of the view that nothing survives in this contempt petition to be adjudicated upon further. Therefore, this contempt petition is closed, however by giving liberty to the petitioner to agitate the matter

before the respondent Corporation with regard to his claim over the differential amount, if any, as stated supra. No costs.
