The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Mandamus directing the respondent to pay 10 percent interest on the belated payment of difference of commutation of pension amount payable to me from the date of retirement to till date of payment made to the petitioner.

ORDER
This Writ Petition has been filed for the issuance of a Writ of Mandamus to direct the respondents to pay interest on the belated payment of difference of commutation of pension amount payable to the petitioner from the date of retirement to till date of payment made to the petitioner.
2. It is the case of the petitioner that the petitioner, who had joined the services of the respondent Corporation had retired from service on 31.01.2017. At the time of his retirement, the respondents settled the terminal benefits, namely, P.F., gratuity, leave salary and commutation of pension, based on the last drawn wages paid in January, 2017. Subsequently, the 13th Wage Settlement came into force with effect from 01.09.2016. Accordingly, the respondents settled the difference in the above terminal benefits based on the 13th Wage Settlement. However, the difference in the commutation of pension was settled
only on 30.01.2021, belatedly after a delay of 48 months, and the interest for the belated payment of the difference in commutation has not been settled till date. Hence, the petitioner has made representation on 30.01.2026 to pay interest for the belated payment, which has not been evoked any response so far. Hence, the petitioner is before this Court.
3. Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondents.

In view of the limited request made by the petitioner with regard to interest on the belated payment of difference of commutation of pension, this Court directs the respondents to pay interest at the rate of 6% for the belated payment from the date of retirement till the date of payment made to the petitioner, within a period of six (6) weeks from the date of receipt of a copy of this order taking into account the bank rate of interest on deposits.
5. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
