ORDER

The writ petition is filed for the below relief: "directing the respondents to pay interest at 10 percent for the belated payment of terminal benefits

such as Gratuity Provident Fund, Leave Salary and communication amount and difference in leave Salary and difference in gratuity with 10 percent interest as per 15th wage settlement dated 29.05.2025 to the petitioners".

2. The brief facts which are culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioners that the petitioners joined as Conductors, Drivers and Technical Staff in the first respondent corporation. The respondents settled their terminal benefits belatedly after 16-26 months. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made representations to the respondents to pay the interest for the belated payment of the petitioners and difference in gratuity with 10% interest as per 15th wage settlement dated 29.05.2025. Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the terminal benefits has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same.

Therefore, the Writ petition is allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of terminal benefits and difference in leave Salary and difference in gratuity with 6% interest as per the 15th wage settlement dated 29.05.2025 to the petitioners within a period of one (1) month from the date of receipt of a copy of this order. Connected miscellaneous petition is also ordered.
