O R D E R

The present criminal original petition has been filed to direct the respondent police to further investigate the matter on the basis of the representation given by the petitioner dated 12.12.2015 and thereby register the case against all the accused as stated by the petitioner in the representation dated 12.12.2015 and investigate and file final report.

2. The case of the petitioner is that on 02.11.2015, he was cruelly and violently attacked by the accused and immediately he was taken to the hospital. While, he was in the bed, he told the police that all the names of the accused could not be recollected as the petitioner was seriously and grievously injured by the accused persons. The First Information Report was registered on the basis of the statement given by the petitioner on 03.11.2015 in Crime No.1348 of 2015 for the https://hcservices.ecourts.gov.in/hcservices/

offences under Sections 147, 148, 341, 294(B), 324 and 506(ii) of IPC r/w Section 3 of TNPPDL Act. All the accused persons came in a Tata Indica Car bearing Registration No.TN 09 BT 9216 and attacked the petitioner. Now, the petitioner recollected all the accused persons names and submitted a representation requesting to include the names of all the accused. Since no action was taken till date, the petitioner came forward with the present criminal original petition.

3. When the matter was taken up for consideration, the learned Additional Public Prosecutor submitted that during the course of investigation, if the investigation officer comes to the conclusion that the other persons were also involved in the occurrence, their names will be included in the FIR.

4. In view of the submissions made by the learned Additional Public Prosecutor, there is no need to give any specific direction to the respondent police. Recording the same, the criminal original petition is closed.
