Comp.A.No.96 of 2021 in C.P.No.57 of 1998 R.SUBRAMANIAN.J., This application has been filed by the third party seeking to purchase the property of the Company in liquidation viz., M/s.Maxworth Orchards (India) Limited.

2. The learned Official Liquidator would submit that they have not brought the subject property situate at Sandanapalli Village to sale. The learned Official Liquidator would also submit that it will be open to the applicant to participate in the auction as and when the properties are brought to sale.

3. When the learned Official Liquidator is obliged to sell the property by public auction, I am at a loss to understand as to how this application could be entertained by this Court. Hence, this application is dismissed as not maintainable.
