Respondents Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus, directing the second respondent to act upon the last representation of the petitioner dated 26.12.2014 in accordance with law and consequently release the arrears payable to the petitioner for the difference in the basic pay, pay fixation, promotion increment, terminal benefits and pensionary benefits as per the calculations annexed thereto.

ORDER

This writ petition has been filed issuance of Writ of Mandamus, directing the second respondent to act upon the last representation of the petitioner dated 26.12.2014 in accordance with law and consequently release the arrears payable to the petitioner for the difference in the basic pay, pay fixation, promotion increment, terminal benefits and pensionary benefits as per the calculations annexed thereto.

2. It is seen that the representation of the petitioner dated 26.12.2014 was not available with the records of the second respondent.

3. Considering the limited prayer sought for in this writ petition, this Court, without expressing any opinion on merits of the writ petition, directs the petitioner to submit a fresh representation before the second respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of such representation, the second respondent is directed to consider the representation, after giving an opportunity of hearing to the petitioner and pass orders on merits and in accordance with law within the period of twelve weeks from the date of the receipt of the representation.

With the above directions, the writ petition stands disposed

of. There shall be no order as to costs.
