Respondents Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents to consider the representation of the petitioner dated 16.06.2021 and to direct the respondents to restore the name of Govt. Higher Secondary School at Thiru Uthirakosamangai, Ramanathapuram District as "MANICKAVASAGER Govt. Higher Secondary School".

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) The writ petition has been filed to seek direction to restore the name of the Government Higher Secondary School at Thiru Uthirakosamangai, Ramanathapuram District as was existing in the past in the name of Manickavasagar Government High School.

The learned counsel for the petitioner has made a reference of the communication of the respondents to call upon a report from the educational officer to find out the name of the school and the learned State Government Pleader has produced a copy of the report of the Chief Educational Officer to indicate that the school was named as Government High School, Thiruuthirakosamangai between 1963-2012 and since 2013, it has been named as Government Higher Secondary School, Thiruuthirakosamangai. The report is taken on record.

So far as the document enclosed by the petitioner is concerned, it would indicate that in the year 1992-93, the name of the School was Manickavasagar Government High School, Thiru Uthirakosamangai, but, however, we find it to be an unsigned document and thus, cannot be relied. It is more so when the name of the student is not mentioned in it, thus, seems to have been a manufactured document.

4. In view of the above, we are not inclined to issue the direction of the nature sought by the petitioner. It is more so when now the school is run in the name of Government Higher Secondary School, Thiru Uthirakosamangai from the year 2013, that is more than 9 years and the certificate was issued to a student in the name of Government High School in the year 199293 and thereupon, from 2013 onwards, it has been changed to Government Higher Secondary School.

Thus, for all the reasons, finding no ground to direct for change of name of the school, the writ petition fails and is dismissed. No costs.
