Respondent PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of Writ of Mandamus directing the respondent office to make necessary correction in respect of date of birth column particularly year column of the petitioner's old Passport No.T636194 issued at Chennai, Tamil Nadu and issue the new passport based on fees paid dated 12.10.2009 and its File No.CO32875, further petitioner enquiry dated 20.11.2012 and 18.12.2012 issued by the competent authority, the date of brith column may correct as 13.03.1975 instead of 13.03.1974.

Heard Mr.P.N.Peruvazhuthi, learned counsel for the petitioner and Mr.N.Ramesh, learned Central Government Standing Counsel for the respondent.

2. The petitioner seeks for a direction upon the respondent to make necessary correction in respect of date of birth, particularly year, in the petitioner's old Passport No.5636194 issued at Chennai, Tamil Nadu and issue new passport based on fees paid dated 12.10.2009 and its File No.CO32875, further petitioner enquiry https://hcservices.ecourts.gov.in/hcservices/

dated 20.11.2012 and 18.12.2012.

3. The learned counsel for the petitioner has submitted that after filing of this writ petition, the respondent has sent a communication dated 10.10.2014 in 1400025_CPC_MAS, by which, the petitioner was directed to submit a fresh application.

4. In the light of the subsequent development, the petitioner is directed to appear before the respondent and comply with the requirements, as pointed out by the respondent in the communication dated 10.10.2014 and if it is done, the respondent shall consider the request of the petitioner on merits and in accordance with law.

5. With the above directions, this writ petition is disposed of. No costs.
