This Criminal Original Petition has been filed directing the Metropolitan Magistrate (FTC) No.IV George Town Chennai to number the complaint lodged by the petitioner.
2. The petitioner is the complainant and respondent is an accused. The complaint lodged by the petitioner for the offence punishable under Section 138 of Negotiable Instruments Act. On receipt of the said complaint, the trial Court is keeping the complaint pending without taking cognizance on the complaint, after recording sworn statement and other supportive witnesses.
3. In view of the above, the learned Metropolitan Magistrate (FTC) No.IV George Town Chennai is directed to proceed with the enquiry and if any cognizable offence is made out, the Metropolitan Magistrate (FTC) No.IV George Town Chennai is directed to take cognizance and issue summons to the accused within a period of six weeks from the date of receipt of of copy of this order.
4. This Criminal Original Petition is disposed of with the above direction.
