When the Second Appeal came up for hearing, learned counsel for the appellants has submitted that the subject matter of the suit has become infructuous and the counsel has also made the following endorsement to that effect:

"As per the instructions from the appellants over phone, the subject matter of the suit has become infructuous. Therefore the appeal may be dismissed as infructuous".
