This petition has been filed to direct the respondent to register the case based on the complaint given to the first respondent dated 6.5.2015, investigate the same and file the final report within a stipulated time.

Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the State.

The learned Additional Public Prosecutor submitted that the petitioner did not co-operate during enquiry, and hence, on the complaint dated 6.5.2015 petition enquiry was conducted on 22.6.2015 and the same was closed.

In view of the said submission, the second respondent is directed to re-open the complaint dated 6.5.2015, and conduct enquiry, and during the course of the enquiry, if any cognizable offence is made out, a regular case shall be registered, following the law laid down by the Hon'ble Supreme Court in Lalita Kumari Vs. Government of Uttar Pradesh and Others reported in (2014) 2 SCC 1. The petitioner is directed to co-operate for the conduct of the enquiry.
The Criminal Original Petition is closed with the above directions.
