Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the 5th respondent to dispose the appeal against the order in Na.Ka.No.722/2017/M3 dated 11.10.2018 on the file of the sixth respondent herein within a period of two weeks. Mr.S.N.Parthasarathy, learned Government Advocate takes notice for the respondents 1, 2, 5 & 6. Mr.P.P.Purushothaman, learned Government Advocate takes notice for the third respondent. Since this writ petition is being disposed of, without affecting the interest of the fourth respondent in any manner, notice to the said respondent is dispensed with.
2. The petitioner seeks for a mandamus directing the fifth respondent to dispose the appeal filed against the order of the sixth respondent dated 11.10.2018 arising out of patta proceedings.
3. The grievance of the petitioner is that the said appeal filed on 12.11.2018 has not been taken up by the fifth respondent till this date.
4. Heard both sides.
5. This Court, at this stage, is not expressing any view on the merits of the claim made by the petitioner in the said appeal, as it is for the fifth respondent to consider and decide the same after hearing all the parties concerned. However, the present writ petition is filed only for early disposal of the appeal pending before the fifth respondent, this Writ Petition is disposed of only with a direction to the fifth respondent to consider the appeal filed by the petitioner and pass orders on the same on merits and in accordance with law, after hearing the petitioner, fourth respondent and other interested parties, if any. Such exercise shall be done by the fifth respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
