C.M.P.No.7023 of 2022 in C.M.A.Sr.No.34223 of 2022 P.T.Asha, J.

Though the caveator name has been printed, none appeared before this Court. This application is filed for condoning the delay of 1360 days in filing the appeal.

2. From a perusal of the affidavit filed in support of the said petition, it is seen that after passing of the award on 29.03.2018, the appellant had come to know that the motor cycle which is shown as offending vehicle in the proceedings was not the vehicle involved in the accident. Therefore, they had filed an application in I.A.No.485 of 2018 to recall the award setting out the entire facts. However, this application came to be dismissed by order dated 12.11.2021. Thereafter, the appellant had filed the above appeal. In the interregnum the Covid pandemic also set in. This has resulted in the delay of 1360 days in filing the appeal.

3. Considering the fact that sufficient reasons have been given, the delay is condoned.
