Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of Writ of Certiorarified Mandamus against the respondent to call for the Income-Tax assessment proceedings for the Assessment year 20052006 in PAN No.AGCPC2102R/B.WI(1) dated 19.11.2007 and it's consequential proceedings dated 28.12.2007 to quash the same as illegal arbitrary and unjust directing the respondent for considering my representation dated 26.12.2007 for fresh assessment after giving opportunity.

When the matter was taken up for consideration, the learned counsel appearing for the petitioner fairly submitted that due to efflux of time, the petitioner may be permitted to approach the appellate authority with a fresh application to ventilate his grievances, for which, the learned counsel appearing for the respondent has no serious objection.

Considering the facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court disposes of this writ petition granting liberty to the petitioner to file a fresh application before the appellate authority, within a period of three weeks from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
