ORDER : The Court Made the following order :- The petitioner who was arrested for the alleged offence under sections 147, 148, 294(b), 323, 324, 506(ii) and 307 IPC altered to 147, 148, 294(b), 323, 324, 506(ii), 307 and 302 I.P.C in Crime No.50 of 2022, filed this petition seeking bail. 2.The petitioner herein is arrayed as A5 in a case where as a retaliation, three persons were brutally attacked, in which one died and the other two persons sustained grievous injury. The incident took place on 17.01.2022. This petitioner was absconding and later, he was secured on 13.03.2022.
3.The learned counsel for the petitioner states that out of 7 accused, the 7th accused was already released on bail by this Court. On parity, this petitioner may also be released on bail. 4.However, on perusing the records, this Court finds that the overtact of the petitioner, being spoken by the defacto complainant that he has attacked one of the victim Vijay with wooden log and by https://hcservices.ecourts.gov.in/hcservices/
hand whereas the overtact of the seventh accused, who was released on bail is that he attacked the mother of the defacto complainant by hand and leg.
5.Considering the said fact that the said victim Vijay has sustained grievous injury, this Court finds that the release of the petitioner herein is not conducive for proper investigation.
