Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Appeal No.639/2017 on the file of the High Court, the High Court will be pleased to enlarge the petitioner on bail, by suspending the sentence imposed on the petitioner by the Learned Special Court for Prevention of Corruption Act, Coimbatore Act, Coimbatore in Special C.C.No.13 of 2011 by its judgment dated 21.09.2017 pending appeal in C.A.NO.sr.44726 OF 2017. Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.Appeal No.639/2017 on the file of the High Court and upon hearing the arguments of M/S.N.
NAGANATHAN, Advocate for the petitioner and of PUBLIC PROSECUTOR on behalf of the Respondent the court made the following order:- The Criminal Miscellaneous Petition has been filed to enlarge the petitioner on bail, by suspending the sentence imposed on the petitioner by the Learned Special Judge for Prevention of Corruption Act, Coimbatore in Special C.C.No.13 of 2011 by his judgment, dated 21.09.2017, pending appeal in C.A.No.SR44726 of 2017.
2. Heard the learned counsel for the appellant and the learned Government Advocate (crl.side) appearing for the respondent.
3. Considering the contention and grounds raised by the petitioner/appellant, sentence alone is suspended on the order passed by the Learned Special Judge for Prevention of Corruption Act, Coimbatore in Special C.C.No.13 of 2011 by his judgment dated 21.09.2017, on condition that the petitioner/appellant shall surrender before the trial Court on 20.10.2017 and execute a bond for a sum of Rs.5,00,000/- (Rupees Five Lakhs Only) with two sureties each for a like sum to the satisfaction of the learned Special Judge
for Prevention of Corruption Act, Coimbatore. Further, the petitioner/appellant shall appear before the trial Court on the first week wednesday of the month at 10.30 a.m until further orders.
