This petition has been filed seeking to condone the delay of 163 days in representing the above C.R.P. SR.No.103637 of 2022.

2. Ms.R.Vidhya Shankar, learned counsel for petitioner submitted that the petition was returned on 22.09.2022 for compliance of certain defects and in furtherance to the same, the petitioner has taken due process to rectify the defects. However, since the petitioner is a company based out of Canada and the counsel on record is based out of Tamil Nadu, he was not able to represent the petition in time. Hence, there is a delay of 163 days arose in representing the above C.R.P. and the said delay caused is neither willful nor wanton, but for the above said reasons. Accordingly, he has filed the above petition.

3. Considering the facts and circumstances, and the reasons stated by the petitioner in the affidavit is justifiable one. Accordingly, this court is inclined to allow this petition and Registry is directed to number the Civil Revision Petition if it is otherwise found to be in order and post the matter for admission on 05.04.2023.
