Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondent to permit the petitioners to surrender the PG Seats allotted to them as free exit without demanding any penalty/deposit amount by considering the petitioner's Representation dated 26.02.2025.

This Writ Petition has been filed for direction directing the respondent to permit the petitioners to surrender the PG Seats allotted to them as free exit without demanding any penalty/deposit amount by considering the petitioner's representation dated 26.02.2025.

2. Heard both sides and perused the materials available on record.

3. Pending writ petitions, the petitioners 5 and 6, retained their Post Graduation studies and continuing their course. Insofar as other petitioners are concerned, they were allotted Post Graduation seats in the Mop-up round and also other rounds. Accordingly, they have been selected and reported to their respective colleges as allotted by the respondent. They had paid their registration fees, security deposit and tuition fees. The petitioner had participated in the Mop-up round counselling for upgradation of their Post Graduation course without the knowledge of the notification dated 14.02.2025 before the closure of deadline. Those seats which were not filled during the extended Mop-up round were moved to the next round of counselling being the stray vacancy round. As per the notification, the respondent called for eligible candidates to participate in the said stray vacancy round. Therefore, the petitioners had requested the respondent to permit them to participate in the

stray vacancy round. Therefore the petitioners had submitted representation seeking permission to surrender their Post Graduation seat without demanding any penalty to the respondent dated 26.02.2025.

On instructions, the learned Standing Counsel appearing for the respondent submitted that after joining the allotted seat of Mop-up round and stray round, its discontinuation fees will be Rs.10 Lakhs for P.G.Diploma course and Rs.15 Lakhs for P.G.Degree course forfeiting the registration fees, security deposit and tuition fees.

5. Considering the facts and circumstances of the case, the petitioners 1 to 4 and 7 are permitted to surrender their Post Graduation seats as free exit without paying any penalty. However, their registration fees, security deposit and tuition fees have to be forfeited and they are not entitled for refund of registration fees, security deposit and tuition fees.

6. With the above directions, this writ petition is disposed of. Consequently, connected Miscellaneous petitions are closed. No costs.
