For Petitioner : M/S.R.SASIKUMAR Advocate For Respondent : MR.S.KARTHIKEYAN, ADDITIONAL PUBLIC PROSECUTOR PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 430 & 379 of IPC, seeks anticipatory bail.

2. Learned counsel appearing for the petitioner would submit that on 03.10.2018, the petitioner was not able to appear before the learned District Munsif Cum Judicial Magistrate, Sriperumandur, in respect of the case in C.C.No.163 of 2014 and hence, non bailable warrant has been issued against the petitioner. He would further submit that the said absence is neither willful nor wanton and he undertakes that the petitioner shall appear before the Court below regularly on all future hearing dates without fail. He would also submit that the next hearing date of the above said case is on 29.05.2020.

3. Learned Additional Public Prosecutor appearing on behalf of the respondent would submit that the non bailable warrant has been issued against the petitioner on 03.10.2018 and the same is pending.

4. Considering the undertaking given by the learned counsel for the petitioner, the petitioner is directed to appear before the learned District Munsif-cum-Judicial Magistrate, Sriperumandur, on the next date of hearing i.e., on 29.05.2020 and to file a petition https://hcservices.ecourts.gov.in/hcservices/

under Section 70(ii) of Cr.P.C., to recall NBW already issued against him. On filing of such petition, the concerned Magistrate is directed to consider the same on merits and pass orders on the same day.
