ORDER

The revision petitioners who are the plaintiffs in O.S.No.9368 of 2021 on the file of XVII Additional City Civil Court, Chennai, has filed the present revision petition seeking for speedy disposal of the suit.

2. The suit is filed for partition in the year 2021. The respondents/defendants have filed their written statement on 02.08.2022. The trial Court has framed the issues and the proof affidavit was filed by the plaintiffs/revision petitioners as early as on 29.12.2022 and the suit was posted for cross-examination of P.W.1 on 13.12.2022 itself. It is in this circumstances, the respondents/defendants with an intention to prolong the case, are filing petitions one after another before the trial Court, and the same was entertained by the trial Court. Hence, the revision petitioners/plaintiffs are before this Court for speedy disposal of the suit O.S.No.9368 of 2021 pending on its file without any progress.

3. Considering the fact that the suit is one for partition, which is pending on its file since 2021, the learned XVII Additional Judge, City 2/4

Civil Court, Chennai, is directed to dispose of the suit O.S.No.9368 of 2021, within a period of four months from the date of receipt of a copy of this order.
