The petitioner, who apprehends arrest at the hands of the 1st respondent police in pursuant to the non-bailable warrant has been issued against him in NACT No.138 of 2021 on the file of the learned Judicial Magistrate Court - 1st Class, Gurugram, Haryana, seeks anticipatory bail. 2.Learned counsel for the petitioner submitted that the petitioner is an accused in NACT No.138 of 2021 on the file of the learned Judicial Magistrate Court - 1st Class, Gurugram, Haryana, for the alleged offences punishable under Section 138 of Negotiable Instrument Act. He further submitted that a false complaint has been given against the petitioner and he has nothing to do with the said allegations.

He also submitted that due to inconvenience, the petitioner did not appear before the learned Judicial Magistrate Court - 1st Class, Gurugram, Haryana, thereby, the learned Judge has issued a Non-bailable warrant as against the petitioner for non appearance. He further submitted that inter State Anticipatory bail may be granted to the petitioner to enable him to move the appropriate jurisdictional Court for appropriate relief. https://www.mhc.tn.gov.

4. Taking into consideration, the facts and circumstances of the case, this Court is inclined to grant interstate interim anticipatory bail to the petitioner for a period of two weeks from today to enable him to move the concerned Court.

5. Accordingly, interim interstate anticipatory bail is granted to the petitioner for a period of two weeks, on condition that the petitioner shall surrender before the learned Judicial Magistrate No.II, Poonamalee, within a period of fifteen days from the date on which the order copy made ready and the petitioner shall execute a bond a for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each for a like sum to the satisfaction of the said learned Magistrate. Further, within two weeks from the date of execution of bail bond, the petitioner shall approach the competent Court in Haryana State and seek for appropriate relief failing which the order shall automatically get cancelled.
