(CRIME NO.128/2022) For Petitioner : M/S.R.RENJITH Advocate For Respondent : MR.S.SANTHOSH, Govt. Advocate ( Crl. Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner herein alleged to have attacked the defacto complainant who objected the petitioner from smoking in front of his house. He has called his friends over phone and along with 9 others the petitioner had attacked the defacto complainant with wooden log near his eye, causing injury. The injured got admitted in the Stanley hospital and from the hospital, on receipt of memo, the police has registered a case in Crime No.128 of 2022 for offences under Sections 294(b), 324 & 506(ii) of IPC.

2. The learned counsel for the petitioner states that for the alleged occurrence took place on 20.03.2022, the First Information Report was registered only on 25.03.2022 belatedly and the facts that are alleged in the complaint are false.

3. However the Accident Register furnished by the learned Government Advocate (crl.side) appearing for the respondent indicates that the defacto complainant has sustained injury over the body, in his eye and admitted in the Government hospital on 20.03.2022 at https://hcservices.ecourts.gov.in/hcservices/

7.30. p.m. The next day the police has recorded his statement and the First Information Report registered after four days. The delay is not due to the defacto complainant.

4. The nature of the injury sustained and the manner in which the defacto complainant was attacked by the petitioner makes this Court to dismiss the petition herein, since the petition if allowed, it will be a threat to the defacto complainant. -sd/- 05/04/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
