ORDER

The appellant herein, as complainant has filed a private complaint under Section 200, Crl.P.C., 1973 wherein the present respondent has been shown as sole accused. The complaint filed by the appellant has been taken on file in C.C.No.718 of 2004. The Trial Court after considering the averments made in the complaint has framed a charge against the accused under Section 420,IPC, and after considering the available evidence on record, has acquitted the accused by way of dismissing the complaint, in question. Against the dismissal order, the present criminal appeal has been preferred.

The learned counsel appearing for the appellant has filed a memo stating that the appellant has received a sum of Rs.40,000/-(Rupees Forty thousand only) from the respondent and to that effect suitable orders may be passed in the criminal appeal.

Considering the fact that the matter between the parties has already been settled and to that effect memo has been filed, the same can be recorded and consequently, the present appeal is liable to be dismissed.

In fine, this criminal appeal is dismissed. The memo filed on the side of the appellant is recorded.
