This Sub Application has been filed to reopen Cont.P.No.2317 of 2022 which was closed vide order of this Court dated 12.10.2023.
2. Heard both sides.
3. Considering the submissions made and being satisfied with the reasons stated in the affidavit filed in support of this application, this Sub Application stands allowed as prima facie there are indications that the order of this Court dated 07.01.2022 in W.P.Nos.10467 of 2021, 14538 of 2020 and 9834 of 2020 has not been complied with which stands affirmed by the Division Bench of this Court vide its order dated 12.09.2023 in W.A.Nos.1358 of 2022 etc., batch.
4. The explanation that is forthcoming from the learned Standing Counsel for the respondents is 8 candidates were shortlisted out of them only two candidates have been disqualified which includes the two petitioners herein.
5. A reading of the order dated 01.03.2024 bearing C.No.R2/860/2019-7 1/3
of the Director General of Police/Chairperson, TNUSRB, Egmore, Chennai indicates that the requirements of the decision of the Hon'ble Supreme Court in Saurav Yadav and others Vs. State of Uttar Pradesh and others, (2021) 4 SCC 542 has not been complied with.
6. The conduct of the official respondents cannot be explained by way of counter affidavit especially in the contempt proceedings. Under these circumstances, while reopening the contempt petition, I direct the official respondents i.e., the first and second respondents to pass suitable orders strictly in compliance with the decision of the Hon'ble Supreme Court in Saurav Yadav and others Vs. State of Uttar Pradesh and others, (2021) 4 SCC 542 by the next date of hearing.
7. After reopening of the contempt petition, list it for hearing on 29.10.2024.
