The petitioners/A1 and A2 in Crime No.3 of 2024 who were arrested and remanded to judicial custody on 03.02.2024, registered by the respondent police for the offences under Sections 366, 451 of IPC r/w Section 5(1), 6, 17 of Protection of Child from Sexual Offences Act, 2012 and 9 and 10 of Child Marriage Restrained Act seek bail.
2. It is stated that the first petitioner had committed an offence of penetrated sexual assault on the victim girl. Thereafter, the father of the victim girl had repeatedly given a complaint before the respondent police. The respondent did not take a complaint on record, but, abused the father of the victim girl. This had forced the father of the victim girl to commit suicide by hitting himself with a hammer on his head. Thereafter, the respondent had proceeded further investigation.
3. It is clear that the Inspector of Police of All Women Police Station, Ulundurpettai, Kallakurichi District at the time of complaint was 1/3
given, had derelicted in discharge of duty. It is also seen that the respondent had also not filed the charge sheet before the trial court.
4. Now, a counter has been filed by the present Officer who is holding position as Inspector of Police of All Women Police Station, Ulundurpettai, Kallakurichi, District.
5. The learned Government Advocate (Crl.Side) raised strong objections to grant bail to the petitioners/ A1 and A2.
6. Taking all those factors into consideration, this Court is not inclined to grant bail to the petitioners.
7. Accordingly, this Criminal Original Petition is dismissed.
8. A copy of this Order may be forwarded to Superintendent of Police, Kallakurichi District to examine the facts of case and provide necessary directions for further investigation. 28.03.2024 Vv 2/3
