The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 323 and 506(ii) of IPC r/w. Section 4 of the Women Harassment Act , in Crime No.7 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that due to wordy quarrel, the petitioner abused the defacto complainant with filthy language, assaulted her and also threatened her with dire consequences. Hence the case.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

4. Per contra, the learned Government Advocate(Crl.Side) for the respondent would submit that the petitioner is a habitual offender, against him, there are thirteen previous cases. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

Taking into consideration the facts and circumstances of the case and the submissions made by the learned Counsel on both sides and also taking note of the fact that the petitioner is a habitual offender, against him, there are thirteen previous cases of similar nature, this Court is not inclined to grant anticipatory bail to the petitioner.
