ORDER
By consent of both parties, this writ petition is taken up for final disposal at the admission stage itself. Since no adverse order is passed against the private respondents, notice to them is dispensed with.
2. This writ petition has been filed for a direction, directing the 2nd and 3rd Respondents to conduct the enquiry and consequently direct the 3rd respondent to cancel the fraudulently obtained Legal heir certificate and to issue a fresh Legal Heir certificate including all the lawful heirs, including the children form the first marriage petitioner and her two sons.
3. It is the case of the petitioner that the petitioner is the second wife of late Kanagasabai. The said Kanagasabai was initially married to one Santhi, through whom four children/private respondents were born and upon her demise on 26.09.1995, Kanagasabai married the petitioner on 23.05.1996 and the marriage was subsequently registered. Out of the wedlock with the petitioner, two children were born. It is the grievance of the petitioner that excluding the petitioner and her two sons, the private respondents have obtained legal heir certificate. Hence, this petition seeking for cancelling the legal heir certificate dated 12.09.2022 and for issuance of fresh legal heirship certificate including
the petitioners name also.
4. Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the official respondents and perused the materials placed on record.
5. Considering the facts and circumstances of the case, this Court without going into the merits of the case directs the petitioner to file an application/representation to the second respondent within a period of two weeks from the date of receipt of a copy of this order, upon receipt of the application, the second respondent are directed to consider the application/representation of the petitioner and pass appropriate orders on merits and in accordance with law after giving appropriate opportunities to the other legal heirs within a period of six weeks thereafter.
