This application has been taken out by the plaintiff since the first defendant, who is the mother of the plaintiff and also of the second and third defendants, had expired on 17.05.2016 and as proof of which, a death certificate has also been filed on 20.06.2016 in this Court.

The learned counsel appearing for the applicant states that apart from the two plaintiffs and the defendants 2 and 3, there are no other legal heirs for the deceased first defendant and consequently, this application is allowed. 3.

The plaintiff is permitted to record the death of the first defendant in the plaint and also file amended copy of the plaint. 4 .
